Real Property Reports list three types of encroachments.
- Improvements built on the subject property that encroach onto adjacent parcels.
- Improvements built on adjacent parcels that encroach onto the subject property.
- Improvements built on rights-of-way within the subject property.
The city (or municipality) is primarily concerned with improvements built on the subject property that encroach onto parcels or rights-of-way owned by the city (or municipality), such as parks, roadways, and lanes.
A Real Property Report showing an encroachment between two privately owned parcels may be granted a stamp of compliance without an encroachment advisory. The prospective buyers and their agents can review the encroachment and may take steps to remedy the encroachment with the neighbour through a formal agreement or by removing the encroaching improvement.
