Does the city flag private encroachments?

Real Property Reports list three types of encroachments.

  1. Improvements built on the subject property that encroach onto adjacent parcels.
  2. Improvements built on adjacent parcels that encroach onto the subject property.
  3. Improvements built on rights-of-way within the subject property.

The city (or municipality) is primarily concerned with improvements built on the subject property that encroach onto parcels or rights-of-way owned by the city (or municipality), such as parks, roadways, and lanes.

A Real Property Report showing an encroachment between two privately owned parcels may be granted a stamp of compliance without an encroachment advisory. The prospective buyers and their agents can review the encroachment and may take steps to remedy the encroachment with the neighbour through a formal agreement or by removing the encroaching improvement.
