How to Spot an Encroachment – Quickly

Most realtors will purchase the certificate of title and email us a copy when ordering a Real Property Report to prevent errors. We knew within minutes of this Real Property Report being ordered that we would find an encroachment. How did we know? There is a caveat listed on this title that is described as an Encroachment Agreement. This agreement can also be purchased from the Land Titles office.

This document contained the agreement established in 2005 allowing for the concrete sidewalk and concrete block fence that fell inside a Utility Right-of-Way. What is more interesting is how this existing agreement affected timing.

  • June 20 – We delivered the real property report to the client and submitted the report to the city for a stamp of compliance.
  • June 21 – The city returned the report with a compliance stamp and an encroachment advisory. We notified our client and sent it directly to the encroachment team at the City of Calgary.  
  • July 3 – The city reviewed the new report, compared the encroachments shown to the existing encroachment agreement and seeing there had been no changes, they issued a final version with the encroachment advisor stamped VOID.
