How to Spot a Bylaw Infraction

Okay, this is an easy one. Placing a shed directly over a drainage swale might seem like a good use of space. However, building anything over that Right of Way contravenes the conditions placed on this piece of land. If there is a swale present, you should expect a Right of Way protects it. In many cases the width of the Right of Way is 1.2m (4 feet) and follows the swale through to the neighboring lots.

Our Real Property Report will detail the swale and the Right of Way, in a way that is easy for land owners to read and understand. We will identify improvements that encroach onto the Right of Way, as well as other property lines.

What to do next

Once an infraction has been identified by the city, we can work through the process on your behalf. The City of Calgary, for example, would forward this concern to the Drainage Group, who handles all things related to Overland Drainage. We will make sure they have the right info, then track and provide updates for you and your client.
