Spot the Encroachment – Fresh Features

From the moment we arrive to survey a Real Property Report at a location with new features we immediately wonder how they determined the position of their property lines. In this case, there is an added layer of interest as there is a Utility Right-of-Way (URW) along the side and back of the property that features a public sidewalk. The sidewalk in the picture falls on the property line and the URW is 10 feet on either side. The corner of the garage (hidden behind the boat) is clear but the new driveway wanders over the line and encroaches onto the city’s URW. 

Is this a bylaw infraction or an encroachment?

The city granted a compliance certificate with an encroachment advisory. The landowner wanted to keep the new driveway and asked that we apply for an encroachment agreement on their behalf. The process took just over four months to complete.
