Spot the Encroachment: Property Flipping! 

Third Rock provided a Real Property Report for an outdated, overgrown property in 2019. Several years later we returned to survey the same property after many renovations had taken place. As pictured here, they removed some scrub brush from the front yard and installed a trendy retaining wall along the sidewalk.  

Can you see the encroachment?

While the retaining wall provides a much-needed facelift for this property, it was built along the sidewalk on city-owned land. The front property line is 3.3m back from the sidewalk, at the top of the concrete stairs. In this case, the landowner had a recent survey in hand and anticipated the eventual need for a development permit and encroachment agreement. This process will add several months to the request for compliance not to mention the additional fees.
