Many neighborhoods in Calgary are built on rolling hills with steep roads, that often feature retaining walls in front yards. This property, which we surveyed last autumn, features a new brick retaining wall. It can be difficult to guess where the property line is located without a proper survey.
Brick Retaining Walls
As you can see, the brick retaining wall is situated on city property. The city reviewed the location and proposed two options to the landowner.
The first option is to remove the brick retaining walls, then update the Real Property Report (RPR) and get compliance re-stamped. Planning will re-stamp compliance if it is done within 6 months of the original stamped date on the RPR.

The second option is to apply for an encroachment agreement. The cost in this scenario will be $500.00 (plus $25.00 gst). Once they receive the complete application, they will circulate for internal review for approval to have these brick retaining walls remain. If approved, the city will enter into an encroachment agreement. If they do not approve, the landowner will be reimbursed $300.00 (plus $15.00 gst) and the encroachments will need to be removed.
Encroachment Agreement
The option to apply for an encroachment agreement is the most common choice. Most of the applications we process for landowners are approved, each of which provides the city with the right to request the removal of the encroachment.
