Terms of Service

Effective date: 27th day of October, 2025

www.thirdrockgeomatics.com (the “Site”) is owned and operated by Third Rock Geomatics (“Third Rock,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) apply to your use of the Site and to the professional land surveying services we provide. By using the Site or engaging our services, you agree to these Terms.

Acceptance

By using the Site, requesting a quote, approving a quote, paying an invoice or deposit, scheduling fieldwork, or otherwise engaging Third Rock, you accept these Terms.

If you act on behalf of an organization or property owner, you represent that you are authorized to bind that party.

Scope of Services

We provide professional land surveying services including, but not limited to: Real Property Reports (RPRs), boundary surveys, topographic surveys, construction staking, and property line marking.

The specific services and deliverables for your project will be identified in our Order Request and related invoice/confirmation.

Project Engagement

A project is considered engaged once you:

Accept a quote or estimate (verbal or written, including email), and/or
Pay any required deposit or invoice (as applicable).

We will confirm engagement via an Order Request and/or invoice. Work may not begin until engagement is confirmed.

Fees and Payment

Quotes are valid for 14 days unless otherwise stated.

Standard invoices are due within 15 days of issuance unless otherwise agreed in writing.

Overdue amounts accrue interest at 1.5% per month (18% annually) beginning 5 days after the due date. You are responsible for reasonable legal and collection costs associated with recovering overdue amounts.

Rush projects:

Require immediate payment in full before survey work is scheduled.
The three-day delivery period for Rush services starts only after we have received payment.

Cancellation and Rescheduling

Cancellation before fieldwork begins:
If you cancel the same day the order is placed and no costs have been incurred, no cancellation fee applies.

Rush cancellation:
A 25% cancellation fee of the quoted total applies once a Rush is ordered.

Cancellation after fieldwork begins:
You will be billed for all time and materials incurred to date, with a minimum charge of 50% of the quoted total.

Rescheduling after crew mobilization or arrival on site:
A $200 rescheduling fee applies to cover crew and logistics.

Client Responsibilities

Ensure clear, safe access to the property and physical boundaries at scheduled times.

Notify tenants, occupants, property managers, and any affected adjacent property owners of our presence and schedule.

Provide complete and accurate property information upon request (e.g., legal descriptions, prior surveys, title).

Deliverables

Unless otherwise stated in your Order Request, deliverables are limited to one signed and sealed PDF of the final survey plan (e.g., an RPR) delivered electronically.

Printed copies, additional sealed sets, or alternate file formats may be available at additional cost upon request.

Changes in Scope

If scope changes due to unforeseen conditions, inaccurate or incomplete information, municipal requests, or client requests, we will issue a revised quote or change order. Additional work proceeds only after approval.

Timelines and City of Calgary Compliance

RPR turnaround commonly quoted as “3–5 business days” reflects Third Rock’s production timeline only.

This estimate does not include and is separate from the City of Calgary’s review or compliance stamp processing timeline, which is outside our control and may extend overall completion time.

Any timeline we provide begins after engagement is confirmed, required payments are received (including Rush), required information is provided, and property access is confirmed.

Limitation of Liability

Our total liability is limited to the fees paid for the specific services that give rise to the claim.

We are not liable for:

Misuse or misinterpretation of survey documents by you or third parties;
Delays or costs arising from weather, access restrictions, incomplete information, or third-party interference; or
Legal, encroachment, bylaw, zoning, permitting, or municipal compliance outcomes based on survey results or municipal review.

City of Calgary decisions (e.g., compliance stamps, encroachment requirements) are at the City’s discretion and are not guaranteed by Third Rock.

Ownership of Work Product

All documents, drawings, data, and work product remain the intellectual property of Third Rock until paid in full.

Upon full payment, you receive a non-exclusive license to use the final deliverables solely for the specific property and purpose identified in the deliverable.

You may not alter or republish sealed documents without our written consent.

Website Use and Content

The Site and its content are provided for general information and marketing purposes and are provided “as is” and “as available.” We strive for accuracy but do not warrant that the Site will be uninterrupted or error-free.

The Site may contain links to third-party sites. We are not responsible for their content or policies.

Modifications to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. When we do, we will update the Effective date above.

Your continued use of the Site or engagement of our services after an update constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. The courts of Alberta have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or our services.
