Overland Drainage Right-of-Way and a Playhouse?

Does it make a difference if there is no swale in a right-of-way?

This beautiful playhouse has great curb appeal. I am sure the owner is proud. The siding matches the house, and it was well built. Unfortunately, it is inside the Overland Drainage Right-of-Way.

…but there is no swale

Not all Overland Drainage Rights-of-Way have swales. In this case the owner may have assumed since there was no swale, there must be no issue building here. This is not the case. The ODRW is like a reserved location where the city has authority on what may be built. In this situation, we applied for and received an agreement with the City of Calgary allowing the playhouse to remain in place. The process to have the encroachment advisory voided took about one month and resulted in a new stamp being added to the report.
